I’m going back to school which will result in my own business, should I inc. now in order to write off equip.?
I’m going back to school which will result in my own business, should I become incorporated now in order to write off the equipment I need to purchase for school? All the equipment will eventually be used within the parameters of the business I will be starting.
From a tax standpoint, you can go into business very easily as a sole proprietor. Once you have the intent to be in business, you are in business. You do not have to be incorporated to depreciate your equipment. Keep track of all your income and expenses, including mileage (55 cents/mile in 2009). If you have a profit, you will have to pay both income tax and social security tax on it. If you have a loss, it will lower your taxable income.
HOWEVER, the IRS says that cannot deduct education expenses and supplies that prepare you for a new business. If you are already in business, you can deduct business-related education and supplies. It is a chicken-and-egg thing. You would be eligible for Hope or Lifetime Tuition credits though, either way. As always, consult with a tax professional for specific answers. CPA Greg – glindatax.com
